The Fire Risk assessment is the responsibility of either:

the owner or manager of a business, even if they don’t own that building and only lease or rent it! For example if they rent a unit within a shopping Mall they still have to have a fire risk assessment if they are responsible for others working for them

• the owner or managing agent of premises which are shared between a number of businesses

• individuals within a multiple-occupancy building, such as self-employed people or voluntary organisations if they control someone within the premises

The recommended way to carry out a risk assessment is to follow a step-by-step process.

• Identify the hazards
• Identify the people at risk
• Evaluate, remove and reduce the risk
• Build in evacuation plans and means of escape and Fire Detection and warning systems
• Ensure the correct fire fighting equipment is available
• Ensure that fire drills and fire safety training is undertaken by staff
• Record, reviewi and revising your fire safety plans

 What the law says....

The law says you must take appropriate action to meet the Fire Precautions (Workplace) Regulations 1997 which require that employers must adopt a proactive role in the fire safety of their employees and the workplace.

 Key to this legislation is the requirement that all places of work have a Fire Risk Assessment carried out by a competent person.

Where there are five or more employees, the Assessment must be in writing. The penalty imposed by a Crown Court for non-compliance is up to two years' imprisonment and/or an unlimited fine or both.
